Fair Hearing Decision A recent decision made by the Department
of Children & Families administrative hearing demonstrated the
importance of having the Qualified Income Trust document done by a
qualified professional. The attorney assisting the nursing home resident
and family created the trust document in March of 1999 but the document
was rejected not once but twice. The approval of the case did not
come until September 1999, a cost to the family of over $19,800 (based on
average nursing home cost of $3,300 as set by the State of Florida). The problem was not one of “failure to cross a
“t” or dot an “i””, stated the final order dated June 8, 2000. The
“insurmountable problem was that the trust simply was not in adequate
condition for authorization” the decision further states. Having a proper
document and the proper funding are critical when dealing with the income
cap in Florida.
If your loved one is entering a
nursing home income and their income is over the state income cap of
$1,737 for the year 2005, you will need a Qualified Income Trust to
qualify for Medicaid benefits. |
